§ 130.90 Facilitating a sex offense with a controlled substance. Apersonisguiltyoffacilitatingasexoffensewithacontrolledsubstancewhenheorshe:

1. Knowingly andunlawfullypossesses a controlledsubstanceor any preparation, compound,mixtureor substancethat requiresaprescriptiontoobtainandadministers suchsubstanceorpreparation,compound, mixtureor substancethat requires aprescription toobtain toanother personwithout suchperson’sconsent andwith intent tocommitagainst such personconductconstitutinga felonydefined inthisarticle; and 2. Commitsorattemptstocommit suchconductconstitutingafelonydefined inthisarticle. Facilitating a sexoffensewitha controlledsubstance is a classD felony. § 130.91 Sexually motivated felony. 1. Aperson commits a sexuallymotivated felonywhenhe or she commits a specified offense for the purpose, inwholeor substantialpart,of hisorherowndirectsexualgratification. 2. A“specifiedoffense”isafelonyoffensedefinedbyanyofthe followingprovisionsofthischapter: assault inthe seconddegreeasdefined in section120.05, assault inthe firstdegreeasdefined in section 120.10, gang assault in the seconddegreeas defined in section120.06, gangassault inthe first degreeasdefined insection120.07, stalkinginthe firstdegreeasdefinedinsection120.60, strangulationintheseconddegreeasdefinedinsection121.12, strangulationinthefirstdegreeasdefinedinsection121.13, manslaughterintheseconddegreeasdefinedinsubdivision oneofsection125.15, manslaughterinthefirstdegreeasdefinedinsection125.20, murderintheseconddegreeas definedinsection125.25, aggravatedmurderasdefinedinsection125.26, murderinthefirstdegreeasdefinedin section125.27, kidnapping intheseconddegreeasdefinedinsection135.20, kidnappinginthefirstdegreeasdefined insection135.25, burglaryinthe thirddegreeasdefinedinsection140.20, burglaryinthe seconddegreeasdefined in section140.25, burglaryinthefirstdegreeasdefinedinsection140.30, arsonintheseconddegreeasdefinedin section150.15, arson inthefirstdegreeasdefinedinsection150.20, robbery inthethirddegreeasdefinedinsection 160.05, robbery intheseconddegreeasdefinedinsection160.10, robberyinthefirstdegreeasdefinedinsection 160.15, promotingprostitution in the seconddegree as defined in section230.30, promotingprostitutioninthefirst degreeasdefined insection230.32, compellingprostitutionasdefined insection230.33, disseminatingindecent materialtominorsinthe firstdegreeasdefinedinsection235.22, useofachildinasexualperformanceasdefinedin section263.05, promotinganobscene sexual performancebya childasdefined in section263.10, promotingasexual performancebyachildasdefined insection263.15, orany felonyattemptor conspiracy tocommit anyof the foregoing offenses. § 130.92 Sentencing. 1. Whenaperson isconvictedof asexuallymotivatedfelonypursuant tothis article, and the specified felony isaviolent felonyoffense,asdefined insection70.02ofthis chapter,thesexuallymotivatedfelonyshallbe deemedaviolentfelony offense. 2. Whenaperson isconvictedof asexuallymotivatedfelonypursuant tothis article, thesexuallymotivated felonyshall bedeemedtobethesameoffenselevelasthespecifiedoffensethedefendantcommitted. 3. Personsconvictedofasexuallymotivatedfelonyasdefinedinsection130.91ofthisarticle,mustbe sentenced in accordancewith theprovisionsof section70.80of this chapter.
