§ 130.40 Criminal sexual act in the third degree. Aperson isguiltyof criminal sexual act inthe thirddegreewhen: 1. Heorsheengagesinoralsexualconductoranalsexualconductwithapersonwhoisincapableofconsent by reasonof some factor other thanbeing less than seventeenyearsold; 2. Beingtwenty-oneyearsoldormore,heorsheengagesinoralsexualconductoranalsexualconductwith aperson less than seventeenyearsold; or 3. Heorsheengagesinoralsexualconductoranalsexualconductwithanotherpersonwithoutsuch person’sconsent where such lack of consent isby reasonof some factor other than incapacity toconsent. Criminal sexual act inthethird degree is aclassE felony. § 130.45 Criminal sexual act in the second degree. Aperson is guilty of criminal sexual act in the seconddegreewhen: 1. Beingeighteenyearsoldormore,heorsheengagesinoralsexualconductoranalsexualconductwith another personlessthanfifteenyearsold;or 2. Heorsheengagesinoralsexualconductoranalsexualconductwithanotherpersonwhoisincapableof consentby reasonofbeingmentallydisabledormentallyincapacitated. It shall beanaffirmativedefensetothecrimeof criminal sexualact intheseconddegreeasdefinedin subdivisiononeof this section that thedefendantwas less than four yearsolder than the victimat the time of the act. § 130.50 Criminal sexual act in the first degree. Apersonisguiltyofcriminalsexualactinthefirstdegreewhenheorsheengagesinoralsexualconductor analsexual

conductwithanotherperson: 1. Byforciblecompulsion;or 2. Whoisincapableofconsentbyreasonofbeingphysicallyhelpless;or 3. Whoislessthanelevenyearsold;or 4. Whoislessthanthirteenyearsoldandtheactoriseighteenyearsoldormore. Criminal sexual act inthe firstdegree isaclassBfelony.

§ 130.52 Forcible touching. Aperson isguiltyof forcibletouchingwhensuchperson intentionally, and forno legitimatepurpose, forcibly touches the sexual or other intimateparts of another person for the purposeof degradingor abusing such person;orforthepurpose ofgratifyingtheactor’ssexualdesire.Forthepurposesofthissection,forcible touchingincludessqueezing,grabbingor pinching. Forcible touching is a class Amisdemeanor. § 130.53 Persistent sexual abuse. Apersonisguiltyofpersistentsexualabusewhenheorshecommitsthecrimeofforcibletouching,as definedin section130.52ofthisarticle,sexualabuseinthethirddegree,asdefinedinsection130.55of thisarticle,orsexualabuse intheseconddegree,asdefinedinsection130.60ofthisarticle,and,within theprevioustenyearperiod, hasbeen convictedtwoormoretimes,inseparatecriminal transactionsfor whichsentencewasimposedonseparateoccasions, of forcibletouching, asdefined insection130.52of thisarticle,sexualabuseinthethirddegreeasdefinedinsection 130.55ofthisarticle,sexualabuseinthe seconddegree,asdefinedinsection130.60ofthisarticle,oranyoffensedefinedinthisarticle,ofwhichthe commissionor

attemptedcommission thereof is a felony. Persistent sexual abuse is a class E felony.
