circumstancessetforthinparagraph(h)ofsubdivisionthreeofsection130.05of thisarticleitshallbeanaffirmative defensethattheclientorpatientconsentedtosuchconductcharged afterhavingbeenexpresslyadvisedbythehealth careormental healthcareproviderthat suchconductwas notperformedforavalidmedicalpurpose. 4. Inanyprosecutionunderthisarticleinwhichthevictim’slackofconsentisbasedsolelyonhisorher incapacity to consentbecauseheor shewasless thanseventeenyearsold,mentallydisabled, or aclient or patientandtheactorisa healthcareprovider,it shall beadefensethatthedefendantwasmarriedtothe victimasdefined insubdivisionfourof section130.00of thisarticle. § 130.16 Sex offenses; corroboration. Aperson shall not be convictedof any offensedefined inthis articleofwhich lack of consent is anelement butresults solelyfromincapacitytoconsentbecauseofthevictim’smentaldefect,ormentalincapacity, oranattempttocommit the same, solelyonthetestimonyofthevictim,unsupportedbyotherevidence tending to: (a) Establishthatanattemptwasmade toengagethevictiminsexual intercourse,oralsexualconduct,anal sexual § 130.20 Sexual misconduct. Apersonisguiltyofsexualmisconductwhen: 1. He or she engages in sexual intercoursewith another personwithout suchperson’s consent; or 2. Heorsheengagesinoralsexualconductoranalsexualconductwithanotherpersonwithoutsuch person’s consent;or 3. Heorsheengagesinsexualconductwithananimaloradeadhumanbody. Sexual misconductisaclassAmisdemeanor. § 130.25 Rape in the third degree. Apersonisguiltyofrapeinthethirddegreewhen: 1. Heorsheengagesinsexualintercoursewithanotherpersonwhoisincapableofconsentbyreasonof some factor other thanbeing less thanseventeenyearsold; 2. Being twenty-one yearsold ormore, he or sheengages in sexual intercoursewith another person less than seventeen yearsold;or 3. He or she engages in sexual intercoursewith another personwithout such person’s consent where such lack of consent isby reasonof some factor other than incapacity toconsent. RapeinthethirddegreeisaclassEfelony. § 130.30 Rape in the second degree. Apersonisguiltyofrapeintheseconddegreewhen: 1. Being eighteenyearsoldormore, heor sheengages in sexual intercoursewith another person less than fifteenyears old;or 2. Heorsheengagesinsexualintercoursewithanotherpersonwhoisincapableofconsentbyreasonof being mentally disabled or mentally incapacitated. It shall beanaffirmativedefensetothecrimeof rape intheseconddegreeasdefined in subdivisiononeof thissectionthat thedefendantwaslessthan fouryearsolder thanthevictimatthetimeoftheact. RapeintheseconddegreeisaclassDfelony. § 130.35 Rape in the first degree. Apersonisguiltyofrapeinthefirstdegreewhenheorsheengagesinsexualintercoursewithanother person: 1. Byforciblecompulsion;or 2. Whoisincapableofconsentbyreasonofbeingphysicallyhelpless;or 3. Whoislessthanelevenyearsold;or conduct,orsexualcontact,asthecasemaybe,atthetimeoftheoccurrence;and (b) Connectthedefendantwiththecommissionoftheoffenseorattemptedoffense.
