(i) anemployeeof the statedepartment of correctional serviceswhoperformsprofessionalduties ina state correctionalfacilityconsistingofprovidingcustody,medicalormentalhealthservices,counselingservices, educationalprograms,orvocationaltrainingforinmates; (ii) anemployeeof thedivisionofparolewhoperformsprofessionalduties inastatecorrectional facilityand who providesinstitutionalparoleservicespursuanttosectiontwohundredfifty-nine-eoftheexecutivelaw; or (iii) anemployeeoftheofficeofmental healthwhoperformsprofessionalduties inastatecorrectional facility orhospital, assuchtermisdefinedinsubdivisiontwoof sectionfourhundredof thecorrectionlaw, consistingof providingcustody,ormedical ormental healthservices for such inmates;or (iv) aperson,includingavolunteer,providingdirectservicestoinmatesinthestatecorrectionalfacilityin whichthevictimisconfinedat thetimeof theoffensepursuanttoacontractual arrangementwiththestate departmentofcorrectionalservicesor,in thecaseofavolunteer,awrittenagreementwithsuchdepartment, providedthatthepersonreceivedwritten noticeconcerningtheprovisionsofthisparagraph;or (f) committedtothecareandcustodyof a local correctionalfacility,as suchtermisdefined insubdivision twoof section fortyof thecorrectionlaw,and theactor isanemployee,notmarried tosuchperson,who knowsorreasonably shouldknowthatsuchpersoniscommittedtothecareandcustodyofsuchfacility. Forpurposesofthisparagraph, “employee”meansanemployeeofthelocalcorrectionalfacilitywherethe person is committedwhoperforms professional duties consistingof providingcustody,medical ormental healthservices,counselingservices,educational services,orvocationaltrainingforinmates.Forpurposes ofthisparagraph,“employee”shall alsomeanaperson, includingavolunteeroragovernmentemployee ofthestatedivisionofparoleoralocalhealth,educationorprobation agency,providingdirectservicesto inmatesinthelocal correctionalfacilityinwhichthevictimisconfinedatthetimeof theoffensepursuant toacontractualarrangementwiththe local correctionaldepartmentor,inthecaseofsucha volunteeror governmentemployee,awrittenagreementwithsuchdepartment,providedthatsuchpersonreceived writtennoticeconcerningtheprovisionsofthisparagraph;or (g) committedtoorplacedwiththeofficeofchildrenandfamilyservicesandinresidentialcare,andthe actorisan employee,notmarriedtosuchperson,whoknowsorreasonablyshouldknowthatsuchpersonis committedtoorplaced withsuchofficeof childrenandfamilyservicesand inresidential care. Forpurposes ofthisparagraph,“employee”means anemployeeoftheofficeof childrenandfamilyservicesorofa residentialfacilitywhoperformsdutiesconsistingof providingcustody,medicalormentalhealthservices, counselingservices,educational services,orvocationaltrainingfor personscommittedtoorplacedwiththe officeofchildrenandfamilyservicesandinresidentialcare;or (h) aclientorpatientandtheactorisahealthcareproviderormentalhealthcareproviderchargedwithrape inthethird degreeasdefined insection130.25,criminal sexualactinthethirddegreeasdefinedinsection 130.40,aggravatedsexual abuse inthe fourthdegreeasdefined in section130.65-a,or sexual abuse inthe thirddegreeasdefined insection130.55, andtheactof sexualconductoccursduringa treatment session, consultation, interview, or examination. Inanyprosecutionunderthisarticleinwhichthevictim’slackofconsentisbasedsolelyuponhisorher incapacityto consentbecauseheorshewasmentallydisabled,mentallyincapacitatedorphysicallyhelpless, itisanaffirmative defensethatthedefendant,atthetimeheorsheengagedintheconductconstitutingthe offense, didnotknowof the factsorconditions responsible for such incapacity toconsent. 2. Conductperformedforavalidmedical ormentalhealthcarepurposeshall notconstituteaviolationofany sectionof thisarticleinwhichincapacitytoconsentisbasedonthecircumstancessetforthinparagraph(h) of subdivision threeof section130.05ofthisarticle. 3. Inanyprosecutionfor thecrimeof rapeinthethirddegreeasdefinedinsection130.25,criminal sexual act inthe thirddegreeasdefined insection130.40,aggravatedsexual abuse inthe fourthdegreeasdefined insection130.65-a, or sexual abuse inthethirddegreeasdefined insection130.55inwhich incapacity to consentisbasedonthe § 130.10 Sex offenses; limitation; defenses. 1.
