controllinghisconductowingtothe influenceofanarcoticorintoxicatingsubstanceadministeredtohim withouthisconsent,or toany other actcommitteduponhimwithouthis consent. 7. “Physically helpless”means that aperson is unconscious or for any other reason isphysically unable to communicateunwillingnesstoanact. 8. “Forciblecompulsion”meanstocompelbyeither: (a) useofphysicalforce;or (b) athreat,expressorimplied,whichplacesapersoninfearofimmediatedeathorphysicalinjuryto himself,herselforanotherperson,orinfearthathe,sheoranotherpersonwillimmediatelybekidnapped. 9. “Foreignobject”meansanyinstrumentorarticlewhich,wheninsertedinthevagina,urethra,penisor rectum,iscapableofcausingphysicalinjury. 10. “Sexualconduct”meanssexualintercourse,oralsexualconduct,analsexualconduct,aggravatedsexual contact, or sexual contact. 11. “Aggravatedsexualcontact”meansinserting,otherthanforavalidmedicalpurpose,aforeignobjectin thevagina,urethra,penisorrectumofachild,therebycausingphysicalinjurytosuchchild. 12. “Healthcareprovider”meansanypersonwho is, or is requiredtobe, licensedor registeredor holds himself or herselfout tobe licensedor registered,orprovides servicesas if heor shewere licensedor registeredin theprofessionofmedicine,chiropractic,dentistryorpodiatryunderanyofthefollowing:article onehundredthirty- one,onehundredthirty-two,onehundredthirty-three,oronehundredforty-oneofthe education law. 13. “Mentalhealthcareprovider”shallmeanalicensedphysician,licensedpsychologist,registered professionalnurse,licensedclinical Socialworkerora licensedmastersocialworkerunder thesupervisionof a physician,psychologistorlicensedclinicalsocialworker. § 130.05 Sex offenses; lack of consent. 1. Whetherornot specificallystated,itisanelementofeveryoffensedefinedinthisarticlethatthesexual actwas committedwithoutconsentofthevictim. 2. Lackofconsentresultsfrom: (a) Forciblecompulsion;or (b) Incapacitytoconsent;or (c) Wheretheoffensechargedissexual abuseor forcibletouching,anycircumstances, inadditionto forcible compulsion or Incapacitytoconsent,inwhichthevictimdoesnotexpresslyorimpliedlyacquiesceintheactor’sconduct;or (d) Wheretheoffensecharged is rape in the thirddegreeasdefined in subdivision threeof section130.25, orcriminal sexual act inthethirddegreeasdefined insubdivisionthreeof section130.40,inaddition to forciblecompulsion, circumstancesunderwhich,atthetimeoftheactofintercourse,oralsexualconduct oranal sexual conduct, the victim clearlyexpressedthat heor shedidnot consent toengage insuchact, and a reasonable person in the actor’s situation would haveunderstood suchperson’swords and acts as an expressionof lackof consent tosuchactunder all the circumstances.

3. A person is deemed incapable of consent when he or she is: (a) less thanseventeenyearsold; or (b) mentally disabled; or (c) mentally incapacitated; or (d) physicallyhelpless;or

(e) committedtothecareandcustodyof thestatedepartmentof correctional servicesorahospital, as such termis defined insubdivisiontwoof section fourhundredof thecorrectionlaw,andtheactorisanemployee, notmarriedto suchperson,whoknowsorreasonablyshouldknowthatsuchpersoniscommittedtothecare andcustodyof such departmentorhospital. Forpurposesofthisparagraph,“employee”means
