Records Policy Educational Rights & Privacy Act

All policieswith regardto student records shall conformwith the FamilyEducational Rights andPrivacy Act (FERPA) 1974. Specific policies describedbeloware intended to supplement the rights and assure the safeguards providedby FERPAand to clarify student records policy at the SUNY College of Optometry. Public Records A. Thefollowinginformationrelatedtoastudentisconsidered“directoryinformation”andtheCollege reservestheright todisclose it toanyoneinquiringwithout thestudent’sconsentunlessthe student, within10daysof thebeginningof eachacademic year,informs theOfficeof Student Affairs ,inwriting,thatthisinformationisnottobemadepublic. Directoryinformationis name,permanentaddressandtelephone,localaddressandtelephone. B. Disclosureof Information 1. Thestudentdirectoryinformationismadeavailabletostudents,facultyandadministrativestaff oftheCollege fortheirownuseonly.Itmaynotbeduplicatedordisseminatedinanywaybythe recipient. 2. The Student Directory, in full or in part, is not disseminated to outside agencies, business concerns, or private individualswithouttheconsentofthevicepresidentforstudentaffairs. 3. Noofficemaintaininganeducational recordofastudentwilldiscloseanypersonallyidentifiable information fromthatrecordtoanyoneotherthanthestudenthim/herselfwithoutthewritten consentofthestudent, exceptasprovidedbelow. 4. Therecordsof the studentwill bedisclosedwithout his/herwrittenconsent toacademic and administrative officerswithintheCollegewhohavealegitimateeducationalinterestinthe information.“Legitimate educationalinterest”meansthedemonstratedneedtoknowbythose personswhoact inthe student’s educational interest.Thisincludes the followingpersonsandtheir professionalandclericalstaffactingunder theirinstructions: a. Vicepresident anddean for academic affairsor associatedean forgraduate studies and research forthe programinvolved, b. StaffoftheOfficeofStudentAffairs, c. President, d. Committees on Course &Standing, e. Facultyofeachclassonlyforstudentsunderacademicdifficulties, f. SUNYAdministrationinAlbanyforTheSUNYInstitutionalResearchInformationSystem(SIRIS). g. Someone fromanoutside partywith a legitimate right toknowasdefinedby the FERPA. 5. Therecordsof a studentwill bedisclosedwithout his/herwrittenconsent tothose federal and state government agenciesandofficialsonly asprovidedby law. 6. The recordsof a student will bedisclosedwithout his/herwrittenconsent to anagency towhich the student has appliedor fromwhichhe/shehas received financial aidorwhichhasmadedecisions concerningeligibility, amount,conditionsorenforcementoftermsofsuchaid. 7. Therecordsof astudentwill bedisclosedwithout his/herwrittenconsent tocertaineducational agencies andinstitutionsonlyaspermittedby law. 8. TheCollegereserves the right to furnish toparentsorguardiansof financiallydependent studentsany information relatingtosuchstudents’academicstatus. 9. Therecordsof astudentwill bedisclosedwithout his/herwrittenconsent tocomplywitha judicial orderor subpoena. 10. Therecordsof a studentwill bedisclosedwithout his/herwrittenconsent inahealthor safety emergency.
