16) anemployeeof thedivisionofparolewhoperformsprofessionalduties inastatecorrectional facility and whoprovidesinstitutionalparoleservicespursuanttosectiontwohundredfifty-nine-eofthe executivelaw; or 17) anemployeeof theofficeofmental healthwhoperformsprofessionalduties inastatecorrectional facilityorhospital, as suchtermisdefined insubdivisiontwoof sectionfourhundredof thecorrection law, consistingof providingcustody,ormedical ormental healthservices for such inmates;or 18) aperson,includingavolunteer,providingdirectservicestoinmatesinthestatecorrectionalfacilityin whichthevictimisconfinedat thetimeof theoffensepursuant toacontractual arrangementwith thestate departmentofcorrectionalservicesor,in thecaseofavolunteer,awrittenagreementwith suchdepartment,providedthatthepersonreceivedwritten noticeconcerningtheprovisionsof thisparagraph;or 19) committedtothecareandcustodyof a local correctional facility,as suchtermisdefined in subdivision twoof section fortyof thecorrectionlaw,andtheactor isanemployee,notmarried to suchperson,who knowsorreasonablyshouldknowthatsuchpersoniscommittedtothecare andcustodyofsuchfacility. Forpurposesofthisparagraph,“employee”meansanemployeeof thelocalcorrectional facilitywherethe person is committedwhoperformsprofessional duties consistingof providingcustody,medical ormental healthservices,counselingservices, educationalservices,orvocationaltrainingforinmates.Forpurposes of thisparagraph, “employee”shall alsomeanaperson, includingavolunteeroragovernmentemployee ofthestate divisionofparoleoralocalhealth,educationorprobationagency,providingdirectservicesto inmatesinthelocalcorrectional facilityinwhichthevictimisconfinedat thetimeof theoffense pursuant toacontractualarrangementwiththelocal correctionaldepartmentor,inthecaseof suchavolunteeror governmentemployee,awrittenagreementwithsuchdepartment,provided thatsuchpersonreceived writtennoticeconcerningtheprovisionsof thisparagraph;or 20) committedtoorplacedwiththeofficeofchildrenandfamilyservicesandinresidential care,andthe actorisanemployee,notmarriedtosuchperson,whoknowsorreasonablyshouldknowthatsuch personis committedtoorplacedwithsuchofficeof childrenand familyservicesandinresidential care.Forpurposes of thisparagraph,“employee”meansanemployeeof theofficeofchildrenand familyservicesorofa residential facilitywhoperformsdutiesconsistingofprovidingcustody, medicalormentalhealthservices, counselingservices,educational services,orvocational training forpersonscommittedtoorplacedwiththe officeofchildrenandfamilyservicesandinresidential care;or 21) aclientorpatientandtheactor isahealthcareproviderormentalhealthcareproviderchargedwith rape inthethirddegreeasdefinedinsection130.25, criminal sexualact inthethirddegreeasdefined insection 130.40,aggravatedsexual abuse inthe fourthdegreeasdefined insection130.65-a,or sexual abuse inthe thirddegreeasdefined insection130.55, andtheactof sexual conductoccurs duringa treatmentsession, consultation, interview, or examination.
