§ 130.00 Sex offenses; definitions of terms. The following definitions are applicable to this article:

1) “Sexual intercourse”hasitsordinarymeaningandoccursuponanypenetration,howeverslight. 2) (a) “Oral sexual conduct”means conduct betweenpersons consisting of contact between themouth and thepenis, themouthandtheanus, or themouthandthevulvaor vagina. (b) “Anal sexual conduct”means conduct between persons consisting of contact between the penis and anus. 3) “Sexual contact”meansany touchingof the sexual orother intimatepartsof apersonfor thepurpose ofgratifyingsexualdesireofeitherparty. It includesthetouchingof theactorbythevictim,aswellas the 4) touchingofthevictimbytheactor,whetherdirectlyorthroughclothing,aswellastheemissionof ejaculate bytheactoruponanypartofthevictim,clothedorunclothed. 5) Forthepurposesof thisarticle“married”meanstheexistenceof therelationshipbetweentheactor and thevictimasspouseswhichisrecognizedbylawatthetimetheactorcommitsanoffense proscribedbythis article against the victim. 6) “Mentallydisabled”means that aperson suffers fromamental diseaseor defectwhich rendershim or her incapableofappraisingthenatureofhisorherconduct. 7) “Mentallyincapacitated”meansthatapersonisrenderedtemporarilyincapableofappraisingor controllinghisconductowingtothe influenceof anarcoticor intoxicatingsubstanceadministeredto him without his consent, or toanyother act committeduponhimwithout his consent. 8) “Physically helpless”means that aperson is unconscious or for any other reason isphysically unable to communicateunwillingnesstoanact. 9) “Forcible compulsion” means to compel by either: a) useofphysical force;or b) athreat,expressor implied,whichplacesapersoninfearof immediatedeathorphysical injury to himself,herselforanotherperson,orinfearthathe,sheoranotherpersonwill immediately bekidnapped. 10) “Foreignobject”meansanyinstrumentorarticlewhich,wheninsertedinthevagina,urethra, penisor rectum,iscapableofcausingphysical injury. 11) “Sexualconduct”meanssexual intercourse,oralsexualconduct,analsexualconduct,aggravated sexual contact, or sexual contact. 12) “Aggravatedsexualcontact”meansinserting,otherthanforavalidmedicalpurpose,aforeign object in thevagina,urethra,penisorrectumofachild, therebycausingphysicalinjurytosuch child.
