16) anemployeeof thedivisionof parolewhoperforms professional duties ina statecorrectional facility and whoprovidesinstitutional paroleservicespursuant tosectiontwohundredfifty-nine-eof the executivelaw; or 17) anemployeeof theofficeofmental healthwhoperformsprofessional duties inastatecorrectional facilityorhospital, as such termisdefined in subdivision twoof sectionfour hundredof the correction law, consisting ofproviding custody,ormedical ormental health services for such inmates; or 18) aperson, includingavolunteer,providingdirectservicestoinmatesinthestatecorrectional facilityin whichthe victimis confinedat thetimeof theoffensepursuant toa contractual arrangementwith the state departmentofcorrectionalservicesor,in thecaseofavolunteer,awrittenagreementwith suchdepartment, providedthat thepersonreceivedwritten notice concerning theprovisions of this paragraph; or 19) committed tothe careand custodyof a local correctional facility, as suchtermis defined in subdivision twoof section forty of the correction law, and theactor is anemployee, notmarriedto suchperson, who knowsorreasonablyshouldknowthatsuchpersoniscommittedtothecare andcustodyofsuchfacility. Forpurposesofthisparagraph, “emplo y ee” meansanemployeeof thelocal correctional facilitywherethe person is committedwhoperforms professional duties consisting of providing custody,medical or mental healthservices, counselingservices, educational services,orvocationaltrainingforinmates.Forpurposes of thisparagraph, “emplo y ee” shall alsomeanaperson, includinga volunteer oragovernmentemployee of thestate divisionofparoleor a local health, educationorprobationagency,providingdirectservices to inmates inthe local correctional facilityinwhichthevictimisconfinedatthetimeoftheoffense pursuant toa contractualarrangementwiththe local correctional department or,inthe caseof suchavolunteeror governmentemployee, awrittenagreementwithsuchdepartment, provided that suchpersonreceived writtennotice concerningtheprovisions ofthisparagraph; or 20) committedtoor placedwiththeofficeofchildrenandfamilyservicesand inresidential care,andthe actorisanemployee,notmarriedtosuchperson,whoknowsorreasonablyshouldknowthatsuch personis committedtoor placedwith suchofficeof childrenand familyservicesand inresidential care. Forpurposes ofthisparagraph, “emplo y ee” meansanemployeeof theofficeofchildrenand familyservicesor ofa residential facilitywhoperformsdutiesconsistingofprovidingcustody, medical ormentalhealthservices, counselingservices, educational services,or vocational training forpersonscommittedtoorplacedwiththe officeofchildrenandfamilyservicesandinresidential care;or 21) a client orpatient andtheactor isahealthcareprovider ormental health careprovider chargedwith rape inthethirddegreeasdefined insection130.25, criminal sexual act inthethirddegreeasdefined insection 130.40,aggravatedsexual abuse in the fourthdegreeasdefined in section 130.65-a, or sexual abuse in the thirddegreeas defined in section130.55, and theact of sexual conduct occurs during atreatment session, consultation, interview, or examination.
